The operation targeted two locations in Lusaka – HK Company in Libala South and Sweet Promo shop in Kamwala Trading area – following a formal complaint lodged by Foam King Manufacturing Company Limited. The complaint cited unauthorized replication of Foam King’s legally registered fabric design by these entities.

Significant Seizure of Counterfeit Products

The raid resulted in the seizure of 803 suspected counterfeit Foam King mattresses, with an estimated value of K449,820. Foam King Manufacturers Limited, the rightful holder of the design in question, was present during the operation and commended the police for their swift and effective action.

Details of the Suspects

The two companies involved in this intellectual property infringement have been identified as:

1. HK Company: Owned by Chinese national Mr. Lu-Mingli, aged 61, residing at plot number 14989 Libala South.
2. Sweet Promo shop: Owned by Zambian national Emmanuel Changala, aged 24, residing at 55 Road Makeni at an unmarked house number.

Legal Actions and Charges

Mr. Lu-Mingli has been formally charged and arrested under the Merchandise Marks Act Chapter 405 of the laws of Zambia. The charges include:

1. Prohibition of sale of goods bearing forged trademark or false trade description Contrary Section 1 (i) and (g)
2. Sale of goods to which any trademark or a mark so nearly resembling a trademark as to be likely to deceive is falsely applied Contrary Section (6) (1) (b)

Meanwhile, Mr. Emmanuel Changala of Sweet Promo shop is cooperating with the police in the ongoing investigations.
